Terms of Service
Last updated 20 October 2026 · Byte Roast L.L.C.
The agreement between you and Byte Roast L.L.C. for the use of ByteRoast Cloud services.
1. Agreement
These Terms of Service govern your access to and use of ByteRoast Cloud, including the website, console, API, CLI and infrastructure services (the "Services"), provided by Byte Roast L.L.C. ("ByteRoast", "we", "us"). By creating an account, joining the waitlist, or using the Services, you agree to these terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes it.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter into a contract. You are responsible for the accuracy of your account information, for safeguarding your credentials and API tokens, and for all activity under your account. Notify us promptly at security@byteroast.com if you believe your account has been compromised.
3. The Services
We provide cloud servers, shared hosting, domain registration and DNS, and backup services as described on the website and in the documentation. Features may change over time. We aim to announce material changes in advance, and we do not remove a paid feature without a reasonable migration path.
Early access, preview and beta features are provided as-is, may change or be withdrawn, and are excluded from any service-level commitment unless we state otherwise in writing.
4. Acceptable use
Your use of the Services must comply with our Acceptable Use Policy and with applicable law. You are responsible for the content and activity of your servers, including content uploaded by your own customers. We may suspend or restrict access to protect the platform, other customers, or third parties, and we will tell you why unless legally prohibited.
5. Fees and billing
Fees are stated on the website and in the console. Cloud VPS is billed hourly with a monthly cap; other services are billed monthly or annually in advance. Prices exclude taxes unless stated otherwise. You authorize us to charge your payment method on a recurring basis until you cancel.
If a payment fails, we may suspend the affected services after notice. Late or unpaid amounts may accrue interest where permitted by law. Fees for services already provided are non-refundable except where required by law or expressly stated in our refund policy.
6. Domains
Domain registration is subject to the rules of the relevant registry and ICANN. We act as your registrar of record for domains registered through us. You are responsible for keeping registrant and contact details accurate and for renewing domains before expiry. We are not responsible for a domain lost because you did not renew it or because your contact details were inaccurate.
7. Intellectual property
You retain all rights to the content and data you place on the Services. You grant us a limited license to host, transmit and back up that content solely to provide the Services. We retain all rights to the Services, the website, the documentation and our trademarks. You may not copy, resell or reverse engineer the Services except as permitted by law or with our written permission.
8. Availability and support
We target the availability commitments described in our Service Level Agreement. Support is provided by email at support@byteroast.com during the hours published on our help page. You are responsible for maintaining your own backups of data that is not covered by our snapshot service.
9. Suspension and termination
You may cancel at any time from the console. We may suspend or terminate your access for material breach of these terms, non-payment, illegal activity, or risk to the platform or other customers. Where reasonable, we will give notice and an opportunity to cure. On termination, we will make data available for a reasonable period, after which it may be deleted.
10. Disclaimers and limitation of liability
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our aggregate liability arising out of or relating to the Services will not exceed the amount you paid us for the affected Services in the twelve months before the event giving rise to the claim.
Nothing in these terms limits liability that cannot be limited by law, including liability for fraud or willful misconduct.
11. Indemnity
You agree to indemnify and hold harmless Byte Roast L.L.C. and its officers, employees and contractors from claims, damages and costs (including reasonable legal fees) arising from your content, your use of the Services, or your breach of these terms or applicable law.
12. Changes
We may update these terms from time to time. Material changes will be announced by email or in the console at least 30 days before they take effect, unless a shorter period is required by law. Continued use after the effective date constitutes acceptance.
13. Governing law and disputes
These terms are governed by the laws of the jurisdiction in which Byte Roast L.L.C. is organized, without regard to conflict-of-law rules. The parties will attempt to resolve disputes informally for at least 30 days before commencing formal proceedings. Nothing here prevents either party from seeking injunctive relief in a court of competent jurisdiction.
